WASHINGTON — The Supreme Court on Monday refused to take an appeal by former Trump lawyer John Eastman related to emails of his turned over to the House committee investigating the Jan. 6, 2021, Capitol riot. Justice Clarence Thomas was not involved in considering or deciding Eastman's request that the Supreme Court toss lower court rulings related to the emails, the court said in declining to hear the case. Thomas' recusal, which was not explained, is the first time he has removed himself from a case involving the Jan. 6 insurrection by a mob of supporters of former President Donald Trump.

The judge assigned to the US Federal Trade Commission’s antitrust lawsuit against Amazon.com has recused himself from the case, according to a court document filed on Wednesday. Senior Judge John Coughenour was assigned to the case on Tuesday, when the antitrust lawsuit was filed against Amazon in federal court in Seattle. Coughenour, an appointee of Republican former President Ronald Reagan, did not cite a reason for dropping off the case in the court filing. The case has been re-assigned to US District Judge John Chun based on rotation, according to the document. Amazon is facing a series of similar but smaller private consumer cases filed in recent years that are pending in the same US federal court with Judge Ricardo Martinez and the FTC has argued its case should be assigned to the same judge to avoid duplication or conflict.

CNN —The Supreme Court returns to Washington to face a new term and the fresh reality that critics increasingly view the court as a political body. Earlier this year, Roberts declined an invitation to appear before the Democratic-led Senate Judiciary Committee to discuss Supreme Court ethics, citing separation of powers concerns. Even if he did believe a formal ethics code is necessary, it’s unclear whether he would need a unanimous vote to move forward. At least twice, the late billionaire businessman Wayne Huizenga sent his personal 737 jet to pick Thomas up and bring him to South Florida, ProPublica reported. Unlike other members of the federal judiciary, the life-tenured justices have no binding ethics code of conduct, though they are subject to certain financial disclosure laws. New Mexico First Judicial District Attorney Mary Carmack-Altwies appointed New Mexico attorneys Kari Morrissey and Jason Lewis to serve as special prosecutors. "My responsibility to the people of the First Judicial District is greater than any one case, which is why I have chosen to appoint a special prosecutor in the 'Rust' case," Carmack-Altwies said in a statement. Reeb, a former district attorney, was named special prosecutor before being elected to New Mexico's legislature last fall.
